Farewell to Şemdinli

On the ground of “lacking investigation,” the 9th Criminal Chamber of the Supreme Court of Appeals on Wednesday overturned the sentence of noncommissioned officers Ali Kaya and Özcan İldeniz, who were going to serve a sentence of nearly 40 years.

Why was it overturned? Because of procedure. That is, the chamber ruled that it had to be a military court that should have handled the case, rather than the local court, which reached the verdict in question. How? The court’s justification reads, “The description of the crime categorizes the soldier under the same crimes committed by terrorist organizations, which is thoroughly based on assumptions transcending the imagination, and on thoughts devoid of legal value.” In that case, the Turkish Parliament’s Susurluk Commission Report was also “transcending imagination,” as the report had similar statements in it. If there is a military uniform involved, there cannot be “terrorism.” I wonder in what sort of penal article this is written.
