The HSYK decree changed the posts of 1,816 judges and prosecutors in the judicial courts while changing the posts of 254 judges and prosecutors serving in administrative courts. A total of 109 new judges and prosecutors have been appointed to the Supreme Court of Appeals and the posts of 51 commercial court judges have been changed.
According to the decree, former Judges and Prosecutors Association (YARSAV) President Ömer Eminağaoğlu was removed from his position as a Supreme Court of Appeals judge and was appointed an İstanbul judge. There is an ongoing disciplinary case against Eminağaoğlu at the HSYK. The Justice Ministry in 2009 requested the disbarring of Eminağaoğlu upon the conclusion of its investigation into a series of questionable rulings that stretch back to 2008.
Former specially authorized Erzurum prosecutors Osman Şanal and Rasim Karakullukçu, whose special authorities were reinstated by the HSYK in April after they were stripped of their authority in February of last year following their investigation of former Erzincan Chief Public Prosecutor İlhan Cihaner, were also appointed to new posts. Şanal has been appointed to Antalya, while Karakullukçu was appointed the Erzurum specially authorized chief public prosecutor.
Şanal and Karakullukçu were investigating former prosecutor Cihaner over his monitoring of a number of religious communities in the city when the HSYK removed his authority. Ministry of Justice inspectors uncovered certain irregularities in 2009 that prompted an investigation into Cihaner on the grounds that he had failed to inform the justice minister of his investigation of the İsmailağa religious community and the Medine Foundation.
Another significant appointment was that of Diyarbakır Chief Public Prosecutor Durdu Kavak, who is the prosecutor who launched the investigation into the Kurdish Communities' Union (KCK), an umbrella organization of various separatist groups affiliated with the Kurdistan Workers' Party (PKK). The prosecutor, who was also investigating unsolved murders in Turkey's southeast during the '90s, was appointed İzmir chief public prosecutor.
The HSYK decree also changed the post of one of the prosecutors overseeing the investigation into Ergenekon, a suspected clandestine criminal network charged with plotting to overthrow the government by creating large-scale chaos in the country. Prosecutor Kasım İlimlioğlu was stripped of his special authority and has been appointed as a judge in Büyükçekmece.
