ECtHR calls high-handed military punishment human rights violation

The European Court of Human Rights (ECtHR) has recently ruled that a room confinement punishment given to a soldier by his commander during his compulsory military service is a human rights violation.

The ECtHR ruled that Turkey violated Article 5 of the European Convention on Human Rights and stated that the penalties of imprisonment during military service can be imposed by authorized or independent judicial bodies and objections to these penalties can also be issued to such courts. Turkey will pay a total of 9,500 euros to Ersin Pulat, who sued the country in the ECtHR.

Pulat, born in 1981, was punished by being confined to his room for seven days on the basis of military law in Diyarbakır in 2007 for leaving his unit without permission. According to Article 171 of theTurkish Armed Forces (TSK) Penal Code, higher-ranking military officers can impose penalties on lower-ranking officers under his control for discipline.
