The General Staff's Military Prosecutor's Office has completed its indictment regarding the Action Plan to Fight Reactionaryism, in which the Turkish Armed Forces (TSK) allegedly made systematic preparations to damage the image of the ruling AK Party government and the faith-based Gülen movement in the eyes of the public, to play down the Ergenekon investigation and to garner support for members of the military arrested as part of the Ergenekon inquest. Ergenekon is a clandestine criminal organization accused of working to overthrow the government. The indictment only charges Çiçek with “damaging the military chain of command,” for which it seeks up to three years in prison. There have been claims that the Military Prosecutor's Office accelerated the submission of the indictment to the military tribunal after a civilian prosecutor's office submitted its indictment into the plot to the İstanbul 13th High Criminal Court on April 15 to be integrated into the trial of Ergenekon. The civilian indictment, which is over 1,000 pages long, points to former İstanbul Mayor Bedrettin Dalan as the prime suspect in the alleged plot. The document also mentions six other suspects, including Çiçek. The indictment reportedly recommends life sentences without the possibility of parole for Dalan and Col. Çiçek on charges of working to bring down the government and membership in an armed terrorist organization. The indictment calls for prison terms of at least seven-and-a-half years for the other suspects.
Taraf claims that the General Staff plans to refer the case to the Court of Jurisdictional Disputes to ensure that the trial is heard by a military court. Brig. Gen. Hıfzı Çubuklu, legal counsel to the General Staff, reportedly met with the president of the Court of Jurisdictional Disputes, Ahmet Akyalçın, to discuss the issue.
