Coefficient ruling challenged at European court

A vocational school student in the Central Anatolian province of Konya applied to the European Court of Human Rights on Wednesday demanding the court issue a stay of execution for a Council of State ruling that retains a system using a lower coefficient to calculate the university admission examination scores of graduates of vocational high schools.
The name of the student has not been revealed. The court drew widespread reaction with its ruling and was accused of acting politically to keep a system that makes it more difficult for vocational school graduates to enroll in an undergraduate program of their choice.

Lawyers of the Public Platform announced that they had applied to both the Council of State and the European court due to the urgency of the matter, demanding a stay of execution of the Council of State’s coefficient ruling.

Holding a news conference at the Konya Dedeman Hotel, the lawyers of the Public Platform, which has around 300 members from provinces such as Konya, Karaman and Aksaray, announced that they objected to the Council of State’s coefficient ruling.

Recalling that the Council of State ruling came in the wake of an appeal by the İstanbul Bar Association against a move by the Higher Education Board (YÖK) to reduce the difference in the coefficients used to calculate the scores of regular and vocational high school students to 13 percent, Süleyman Küçüksucu, spokesman of the platform, said: “The İstanbul Bar Association had applied to the Council of State for the cancellation of the YÖK decision by relying on Article 95 of the Lawyers’ Law, which is about the lawyers’ mission to care for the supremacy of the rule of law as well as protecting and caring for human rights. The relevant article entitled lawyers to remove obstacles before human rights and freedoms. The İstanbul Bar Association acted against this article.”

Fevzi Kayacan, a member of the platform, said the referral of the Council of State to the European court concerning the coefficient problem was a first in Turkey, while noting that the European court would evaluate the application and reach a conclusion as soon as possible.
