Erzurum prosecutor denied permission to search command center

11 February 2010 / TODAY’S ZAMAN, İSTANBUL
Erzurum public prosecutor Osman Şanal was not allowed to conduct a search at the command center of the 3rd Army in Erzincan on Tuesday as part of an ongoing probe into Ergenekon, a criminal organization accused of plotting to overthrow the government.

The prosecutor has for some time been working on an alleged military plot drafted by a colonel aiming to undermine the Justice and Development Party (AK Party) and the faith-based Gülen movement. The plot is reportedly a product of Ergenekon.

On Tuesday, Şanal traveled to Erzincan to interrogate two noncommissioned officers and a civilian on suspicion of links to the plot.

He also conducted a search at the homes of noncommissioned officers M.Y. and A.S. The two officers and the civilian were later taken into custody.

In light of documents seized in the home of A.S., Şanal decided to search the office of the noncommissioned officer at the 3rd Army command center. He asked the Erzurum 2nd High Criminal Court for a warrant to search A.S.’s office. With the search warrant in hand, Şanal arrived at the center, but was denied permission to enter the facility.

Officers at the center said he would not be allowed to enter the facility except upon an “order from the General Staff.”

The three detainees are expected to appear at an Erzurum court after a detailed interrogation by the prosecutor. The 3rd Army was the focus of attention in Turkey in late December after its commander, Gen. Saldıray Berk, was summoned by Şanal to testify as part of the Ergenekon probe. The general, however, refused to go to the courthouse and denied the prosecutor entrance to the command center.

Şanal launched his investigation after a large amount of munitions, including hand grenades, was found on Oct. 27, in an Erzincan reservoir. He initiated the probe to figure out whether the ammunition was linked to Ergenekon. Two gendarmerie officers were arrested on Nov. 25 over their connection to Ergenekon and the secret munitions caches. Weapons and bullets were found in the home of one of the arrested suspects during the operation.

A colonel was arrested recently due to suspected links to the plan.
