Court rejects Doğan’s appeal to dismiss case

27 January 2010 / MEHMET ÇAPKAN/ÜSAME ARI, İSTANBUL
A court in İstanbul’s Küçükçekmece district yesterday rejected an appeal filed by Doğan Yayın Holding that sought to dismiss a lawsuit filed against it by the Capital Markets Board (SPK).

Following the complaint by the SPK, Turkey’s exchange watchdog, against Aydın Doğan, the ex-chairman of Doğan Yayın, and three other executives for deliberately incurring financial loss to Doğan Holding in 2003, the İstanbul Public Prosecutor’s Office filed criminal charges against Doğan, Doğan Holding Deputy Chairwoman İmre Barmanbek and Doğan Holding board members Hanzade Vasfiye Doğan and Ali Rıza Temuroğlu.

The prosecutor called for prison sentences ranging from two-and-a-half years to eight years, nine months. Doğan Yayın then appealed to the court, demanding that the criminal charges be dismissed because the statute of limitations had expired.

The court ruled that the charges were still valid and that Aydın Doğan and the defendants would be summoned to the next trial on March 29.
