Erzurum prosecutor denies Kılıçdaroğlu’s search warrant claims

Kılıçdaroğlu’s claims that an Erzurum court prepared a blank search warrant to be used as officials wished were denied.

Erzurum Chief Public Prosecutor Sinan Kuş held a press conference on Thursday, denying claims by Republican People’s Party (CHP) parliamentary group deputy chairman Kemal Kılıçdaroğlu that an Erzurum high criminal court issued a search warrant on which the name and address sections were left blank.

Kuş stated that the office covered the name and address sections of the warrant on purpose when faxing it to the Erzincan Central Command. “Those parts were covered so as to protect them against any prospect of obfuscation. The warrant was faxed to the Erzincan Central Command to inform them. The original warrant was sent to officials at the command by prosecutors,” Kuş added.

Kılıçdaroğlu claimed in Parliament on Wednesday that the Erzurum 2nd High Criminal Court prepared a sample search warrant and sent it to third parties to be used during police searches at the addresses of suspected individuals. The name and address sections of the warrant were left unfilled, according to Kılıçdaroğlu, to allow prosecutors to fill them for a search at the address of any suspect.

“This warrant is like a check prepared for the holder. You can fill in the blanks as you wish and carry out a search at any house or office. For whom was this warrant prepared? We are waiting for an explanation from the justice minister and the prime minister. We are calling on members of the Supreme Board of Judges and Prosecutors [HSYK] to fulfill their investigative duty,” Kılıçdaroğlu stated.

Kılıçdaroğlu also distributed a copy of the warrant to members of the press after his speech in Parliament.

It was later revealed that the warrant the CHP parliamentary group deputy chairman was referring to was one served on the head of the National Intelligence Organization’s (MİT) Erzincan branch and two other MİT officials. The three were arrested on Dec. 9 by the Erzurum Public Prosecutor’s Office on charges of membership in Ergenekon, a clandestine organization charged with plotting to overthrow the government.

After a sizeable cache of munitions, including hand grenades, was found on Oct. 27 near an Erzincan dam, the Erzurum Public Prosecutor’s Office launched an investigation into the apparent existence of a clandestine network in Erzincan connected to Ergenekon.

“The search warrant bears the names and addresses of individuals whose houses were to be searched by police,” prosecutor Kuş stressed.

According to Kuş, Kılıçdaroğlu violated the principle of confidentiality of an ongoing judicial process by distributing a copy of the search warrant to members of the press. The prosecutor is expected to file a criminal complaint against newspapers that published the warrant.

In the meantime, Kılıçdaroğlu held a press conference on Friday and claimed that the Erzurum 2nd High Criminal Court had two search warrants. The names and addresses on the first warrant were covered, while they were not on the second warrant.

“We did not disclose the first warrant due to our respect for the judiciary,” he stated.
