Erdoğan files lawsuits against MHP leader

9 September 2009 / TODAY'S ZAMAN, İSTANBUL
Prime Minister Recep Tayyip Erdoğan has filed two lawsuits against Nationalist Movement Party (MHP) leader Devlet Bahçeli, accusing Bahçeli of making libelous remarks in two recent statements.

In a petition prepared by Erdoğan's lawyers, two written statements issued by Bahçeli on Aug. 22 and 25, criticizing the government's recent democratic initiative to settle the Kurdish issue, were cited. Lawyers said on Aug. 25, Bahçeli used expressions such as “the person whose honor is denigrated,” “the person whose personal record is defamed,” “the main actor of the global plot” and “hypocrite” while referring to Erdoğan. They said Bahçeli also accused Erdoğan of “preparing heinous plans against the nation by working hand-in-hand with foreign forces.”

Erdoğan's lawyers also recalled remarks Bahçeli made on Aug. 22, when he said Erdoğan's “rude and unethical remarks” in response to Bahçeli's criticism were targeting the nationalist movement.

In the petition, the lawyers said Bahçeli's remarks go far beyond the bounds of freedom of expression and his statements aimed to defame Erdoğan in the eyes of the public.

Erdoğan's lawyers demand TL 100,000 from Bahçeli as compensation in each case.

Court drops case of teenager insulting PM

An Aydın court on Tuesday dismissed a case against a teenager who allegedly insulted Prime Minister Erdoğan at the end of a Justice and Development Party (AK Party) rally on March 9.

The first hearing of the case against 13-year-old M.S.Ö. was held at the Aydın Juvenile Court, which ruled that the offense does not necessitate legal action in line with Article 32/1 of the Turkish Penal Code (TCK). The hearing was closed to the press because the suspect is a minor. The teenager allegedly shouted at Erdoğan, saying, “God will punish you,” while Erdoğan was touring the city as part of his party's election campaign for the March 29 local polls.

M.S.Ö. was defended by 23 lawyers from the provinces of İstanbul, İzmir, Adana, Denizli and Ankara. Republican People's Party (CHP) Aydın deputy Fatih Atay and İzmir deputy Ahmet Ersin were also in Aydın to follow the case, but they could not enter the courtroom because of the confidentiality of the case.

Speaking to the NTV news station, one of M.S.Ö's lawyers, Kemal Aytaç, said: “The trial of M.S.Ö is a controversial issue. Everyone protects the prime minister, but this teenager is the one who should be protected here. Although an illegitimate indictment was prepared against him, the court saw this.
