Eighty-six suspects were indicted in a 2,455-page document made public last summer. The trial started in late October of last year, and if the new indictment is accepted by the 13th Higher Criminal Court, it will be merged with the original document. The initial investigation started on June 12, 2007, and the first indictment was submitted to a court in July 2008. The second indictment charges individuals detained or arrested in police raids conducted as part of the investigation held between July 10, 2008 and the start of this year.
In the second indictment -- a 1,909-page document -- 56 individuals are indicted, 21 of whom are suspects in custody, while 35 were released pending trial.
The indictment has not yet gone public, as the prosecution will send the document to the defense lawyers only when it receives the court's official acceptance, expected within the next 15 days. However some information regarding the content of the indicmtent has been revealed. According to these reports, some of the key figures accused of various crimes in the new indictment include retired generals Şener Eruygur, Hurşit Tolon and Levet Ersöz; retired Col. Atilla Uğur; Cumhuriyet daily Ankara Bureau Chief Mustafa Balbay; Ankara Chamber of Commerce (ATO) Chairman Sinan Aygün; former Police Chief Adil Serdar Saçan; and former Esenyurt Mayor Gürbüz Çapan.
Prosecution demands 13 life sentences for two generals Although the indictment has not yet been made public, news reports say two key suspects facing charges of leading the organization are retired generals Hurşit Tolon and Şener Eruygur. According to reports, the prosecution is demanding 13 consecutive life sentences for Tolon and Eruygur without the possibility of parole. The İstanbul Prosecutor's Office announced that 10 of the suspects in the new indictment are facing charges of holding leadership positions in the organization, while 40 others face charges of membership in it. Four others are suspected of aiding and abetting Ergenekon. Two of the suspects are being charged with leading the organization, attempting to overthrow the Turkish Parliament and the government of the Republic of Turkey or blocking it from functioning completely or partially, inciting people to armed revolt against the government, sharing documents pertaining to state security, acquiring such documents, recording private information belonging to other individuals illegally, attempting to influence the judiciary and falsifying official documents. Four of the suspects, according to the prosecution's statement, are being charged with leading the organization, attempting to overthrow the Turkish Parliament and the government of the Republic of Turkey or blocking it from functioning completely or partially, encouraging insubordination by soldiers, recording private information belonging to other individuals illegally and attempting to influence the judiciary. The indictment also mentions secret meetings held between army officers at the Kent Hotel, as well as meetings at the Büyük Klüp, a private club in Kadıköy, of a group known as Encümen'i Daniş, which comprised former generals and bureaucrats. The prosecution asserts that in these meetings, these individuals discussed the country's political landscape and took certain decisions that would be kept confidential.
The new indictment accuses Ergenekon of some of the shadiest violent attacks and murders in Turkey's history, including the Gazi events of 1995, in which 17 people were killed in İstanbul's Alevi-dominated Gazi neighborhood when unidentified individuals opened fire on a local cafe. Among other accusation are those for the August 2001 murder of Üzeyir Garih, a Jewish-Turkish businessman stabbed to death in a Muslim cemetery in İstanbul's Eyüp district; the 2002 murder of secularist academic Necip Hablemitoğlu; and the 2006 murder of businessman Özdemir Sabancı.
Other accusations include three coup attempts by military generals in the early 2000s codenamed Yellow Girl, Moonlight and the Glove. There is also an investigation into alleged secret meetings at "karargah houses" held by war academy students and younger officers as part of the planning process to overthrow the government.
The new indictment includes a large number of witnesses, the identity of whom will remain confidential, and documents. It consists of five chapters, the first outlining the proceedings of the current trial, in which 86 suspects are being tried. The second chapter details the structure of the Ergenekon organization, followed by a third chapter on the crimes and atrocities allegedly committed by the group. The fourth chapter is on Ergenekon's civil society and media affiliations. The fifth and final chapter details the charges being pressed on each individual implicated.
Ergenekon accused of Sivas, Gazi massacres The prosecution accuses Ergenekon of the following crimes in the new indictment: 1) Organizing the Sivas massacre of July 2, 1993, which resulted in the deaths of 37 Alevi intellectuals. The victims, who had gathered for a cultural festival in Sivas, were killed when a mob of religious fundamentalists set fire to the hotel where the group had assembled. 2) The Gazi neighborhood incident on March 12, 1995, when unidentified individuals opened fire with automatic weapons at a store and three coffee shops in the Gazi quarter of Gaziosmanpaşa, a district of İstanbul. Twenty-five people were injured and one died before the perpetrators killed a taxicab driver and fled the scene in the stolen vehicle. 3) Organizing the Başbağlar massacre, which came three days after the Sivas massacre. The Kurdistan Workers' Party (PKK) attacked Erzincan's Başbağlar village, and 29 people were killed on July 5, 1993. 4) The bombing of a public park in Diyarbakır which resulted in the deaths of 11 people, including eight children, on Sept. 12, 2006. 5) The killing of a general in the Lice district of Diyarbakır on Oct. 22, 1993. Bahtiyar Aydın, known for his stance that terrorism could never be stopped by military force, was assassinated with a single bullet. 6) Violence that broke out in Ümraniye Prison during simultaneous operations by the police in Turkey's jails on Dec. 19, 2000 following mass demonstrations and hunger strikes by inmates, which began in October of the same year in protest of new F-type prison facilities. 7) The execution of 33 soldiers by firing squad in 1993 on the Bingöl-Elazığ highway. |
