Prosecutor seeks first-degree murder charge for ‘warning’ shots

Baran Tursun, a 20-year-old university student, was shot to death on Nov. 24, 2007 after ignoring police officers’ calls to stop his vehicle.

An Izmir prosecutor has filed a motion against a police officer accused of shooting 20-year-old Baran Tursun to death after Tursun refused to stop despite the officer’s warning. The motion seeks up to 25 years in prison for what the prosecutor calls “willfull,” or first-degree, murder.
Public Prosecutor Cengiz Bardak completed the investigation in the case that resulted in Tursun’s death following a police chase on Nov. 24, 2007. After ignoring police officers’ calls to stop his vehicle, Tursun crashed his vehicle in İzmir’s Karşıyaka district. Emergency doctors treating Tursun found the cause of his injuries stemmed not from the accident, but from a bullet lodged in his head. He was declared brain dead and died five days after at Ege University hospital where he was being treated.

One of the policemen, O.A, who was involved in stopping Tursun’s car and the party who fired the “warning” shots, has been in custody since the accident and will stand before the judge on Jan. 14. The other policeman involved, V.A, was released.

Meanwhile, the İzmir Crime Laboratory released a ballistics report yesterday on the bullet removed from Tursun’s head. According to the Anatolia news agency, the expert report indicates that the bullet in question was shattered, underlining that a bullet fired directly will not shatter, rather it had either ricocheted off nearby debris or passed through glass beforehand. The ballistics report will be included in the case file pending at the Karşıyaka 1st Criminal Court.
